Terms of Service

These Terms and Conditions ("Terms") govern your access to and use of the Kinjie platform, including our website, applications, and booking services (collectively, the "Service"), operated by Jason Bonnici and Manuel Baldacchino, trading as Kinjie, of 21, Triq Gwiedi, Zejtun, Malta ("Kinjie", "we", "us", or "our"). By creating an account or using Kinjie, you agree to these Terms. An "Agency" means a business that manages multiple providers or practitioners on Kinjie on their behalf; where these Terms refer to a "provider or agency," the same obligations apply to both, adjusted only for the fact that an agency acts for other people's listings rather than only its own.

1. About Kinjie

Kinjie connects clients with local service providers. We provide the technology to discover services, manage bookings, and operate provider and agency workflows. Kinjie is an intermediary platform: we are not a party to, and do not guarantee the performance of, the service or product delivered by a provider. Responsibility for delivering a booked service or product remains with the individual provider or business you book with. Kinjie is likewise not the employer of, and has no employment or equivalent relationship with, any staff, practitioner, or team member a provider engages to help deliver their services — see Section 5.

2. Eligibility and accounts

You must be at least 16 years old to use Kinjie. When you register, you agree to:

  • Provide accurate and current information.
  • Keep your login credentials secure and notify us of unauthorised access.
  • Accept responsibility for activity under your account.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to users or the platform, in accordance with Section 6 below.

3. Bookings and cancellations

When you make a booking through Kinjie, you enter into a service arrangement with the relevant provider. Cancellation windows, rescheduling rules, deposits, and no-show policies may vary by provider and are shown at the time of booking where applicable. See Section 7 for how provider-specific terms are handled.

Kinjie may facilitate reminders, calendar integration, and no-show reporting, but enforcement of provider-specific policies is primarily between you and the provider.

4. Payments, fees, and product orders

Payment terms, pricing, and refunds for service bookings are set by providers unless otherwise stated on the booking flow. Kinjie or its payment partners may process transactions on behalf of providers. You authorise us to charge the payment method you provide for confirmed bookings, product orders, and applicable platform fees.

Prices Kinjie displays for its own subscriptions, add-ons, and platform fees are shown exclusive of VAT. Any VAT that applies will be calculated and added at checkout before you complete payment. This does not affect the price a provider sets for their own services or products, which remains the provider's own responsibility to display and account for correctly, as described in Section 5.

Because a service booking is tied to a specific date and time, it is generally exempt from the standard EU 14-day right of withdrawal once you have requested and the provider has confirmed performance is to begin on that date. This exemption does not apply to physical product orders placed through Kinjie's marketplace: where you order a physical product from a provider's store, you have the standard right to withdraw within 14 days of receipt unless a statutory exception applies (for example, the product is made to your specification, is perishable, or its seal has been broken after delivery for hygiene reasons). 5. Provider and agency obligations

If you use Kinjie as a provider or agency, you agree to:

  • Maintain accurate service listings, availability, and pricing.
  • Honour confirmed bookings or offer reasonable alternatives.
  • Comply with applicable licensing, tax, and consumer protection laws in the jurisdictions where you operate, including Malta's Consumer Affairs Act (Cap. 378) where applicable.
  • Handle client data lawfully and only as needed to deliver booked services.
  • Hold any professional licence or qualification required to lawfully provide the services you list.
  • Engage any staff, practitioners, or team members who help you deliver services in compliance with Malta's Employment and Industrial Relations Act (Cap. 452) and any other applicable employment or engagement law, including as to lawful pay, working time, and rest periods. Kinjie is not the employer of your staff, practitioners, or team members, and has no employment or equivalent relationship with them.
  • Not use, and take reasonable steps to ensure nobody you engage to help deliver your services uses, forced, bonded, or compulsory labour, or otherwise engages in or facilitates human trafficking or modern slavery in any form.

6. Platform changes, suspension, and termination

This section applies to you if you use Kinjie as a provider, agency, or other business user of the platform.

Changes to these Terms: where a change to these Terms would affect you as a business user, we will give you at least 15 days' notice before the change takes effect, by email or in-app notice. You may terminate your provider agreement with us at any time before the change takes effect, without penalty, by writing to [email protected]. If you continue to submit new listings or services after being notified of a change, that is treated as acceptance of the change, unless the change requires you to make significant technical or commercial adjustments, in which case continuing to use existing listings alone is not treated as acceptance. We may shorten or skip this notice period where we are required to change these Terms to comply with law, or where we must act urgently to address fraud, a security incident, or imminent harm to users or the platform — in that case we will tell you why, without undue delay.

Restriction or suspension: if we restrict or suspend your ability to offer a specific service or listing, we will tell you why, before or at the time the restriction takes effect, referencing the specific facts involved.

Termination: if we terminate your entire provider account, we will give you at least 30 days' notice and a statement of reasons, except where we are legally required to act faster, or where you have repeatedly and materially breached these Terms. Before any termination takes effect, you may raise the issue with us at [email protected] and we will consider your response before the termination is finalised.

7. Store-specific terms

Providers may publish their own additional terms for their store (for example, their own cancellation, deposit, or no-show policy). Kinjie does not review, endorse, or guarantee that a provider's own store terms comply with applicable consumer protection law, including the unfair contract terms rules in Malta's Consumer Affairs Act (Cap. 378). Providers are solely responsible for ensuring their own store terms are fair, lawful, and enforceable. If you believe a provider's store terms are unlawful, contact us at [email protected] and we will review the listing.

8. Acceptable use, illegal activity, and cooperation with authorities

You must not misuse the Service. Prohibited conduct includes:

  • Harassment, fraud, or impersonation.
  • Attempting to bypass security, scrape data, or disrupt the platform.
  • Posting unlawful, misleading, or infringing content.
  • Using Kinjie for purposes unrelated to booking or operating listed services.
  • Using Kinjie, in any way, to advertise, arrange, or carry out an illegal activity, including where the true nature of a listed service is misrepresented or disguised as something lawful.
  • Posting or uploading content — including images, listing descriptions, or reviews — that would violate the acceptable use policies of Kinjie's own hosting, infrastructure, or technology providers, even where that content might not independently be unlawful.

Kinjie provides the platform only. We are not a party to, and do not supervise or vet, the actual service a provider delivers, and we do not knowingly permit illegal activity to take place through Kinjie. If we become aware, whether through our own review, a user report, or otherwise, that the platform has been or is being used for an illegal purpose, we will act on it: we may suspend or terminate the account involved in accordance with Section 6, and we will report the matter to the relevant law enforcement or regulatory authority as soon as reasonably practicable after we detect it.

If the police, a regulator, a court, or another competent authority contacts us in connection with a suspected illegality or an investigation, we will cooperate as required by law, including by providing account, booking, or other information we hold about the user(s) concerned where we are legally obliged, or lawfully permitted and it is reasonable to do so. This is in addition to, not instead of, the data-sharing practices described in our Privacy Policy.

9. Intellectual property

Kinjie and its branding, software, and content are owned by us or our licensors. You receive a limited, non-exclusive licence to use the Service for its intended purpose. You retain ownership of content you submit, but grant us a licence to host and display it as required to operate the platform, including displaying provider listings to prospective clients and, where applicable, through additional distribution channels we may introduce (we will notify affected providers before doing so).

10. Disclaimers and liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Kinjie is not liable for indirect, incidental, or consequential damages arising from your use of the platform or from services delivered by providers. Our total liability for any claim relating to the Service is limited to the amount you paid to Kinjie in the twelve months before the claim, or €100 if no fees were paid.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under the laws of Malta, including Cap. 378.

11. Dispute resolution

If you are a consumer based in Malta, you may bring a claim relating to these Terms before the Consumer Claims Tribunal where the value of your claim does not exceed €10,000, as an alternative to the ordinary courts, in accordance with Cap. 378. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Nothing in these Terms requires you to use arbitration or waives your right to bring a claim before a court or tribunal.

12. Indemnity

If you are a provider or agency, you agree to indemnify and hold Kinjie harmless from any claim, loss, or expense (including reasonable legal costs) arising from: (a) the service or product you actually delivered to a client; (b) your breach of these Terms or of applicable law; or (c) content you publish on the platform, including your own store terms. This does not require you to indemnify us for our own negligence or breach of these Terms.

13. Anti-money laundering and identity verification

Payments made through Kinjie are processed by a licensed payment service provider, which carries out its own identity verification and anti-money laundering checks on providers and clients in accordance with applicable law, including Malta's Prevention of Money Laundering Act (Cap. 373) and Financial Institutions Act (Cap. 376). Kinjie does not itself hold a payment institution or e-money licence. We may ask you for additional information to verify your identity or business where reasonably necessary to protect the platform.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. For changes affecting you as a business user of the platform, see Section 6. For all other users, continued use of Kinjie after changes take effect constitutes acceptance of the revised Terms.

15. Governing law and contact

These Terms are governed by the laws of Malta. The courts of Malta have non-exclusive jurisdiction over any dispute, without prejudice to your right to bring a claim before the Consumer Claims Tribunal under Section 11. Questions about these Terms may be sent to [email protected].

16. General

If any part of these Terms is found unenforceable, the rest continues to apply, and the unenforceable part will be treated as changed only as much as needed to make it enforceable. These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and Kinjie regarding the Service, and replace any earlier discussions or agreements on the same subject. We may transfer our rights and obligations under these Terms, for example as part of a merger, acquisition, or corporate restructuring; we will notify affected users of any such transfer. We are not liable for a failure or delay caused by circumstances reasonably beyond our control, including an outage or action by a hosting, infrastructure, or payment provider we rely on. If we do not enforce a right under these Terms on one occasion, that does not waive our ability to enforce it later. Where these Terms are made available in more than one language, the English version governs if there is any conflict or inconsistency between versions.
